From the DA's Office: Prison inmate pled guilty to escape

The following are from State Correctional Facilities in Attica who were seen before Wyoming County Judge Michael Mohun April 20. 

Bail is set for state inmate cases for two reasons: 1) In the event that the inmates current sentence is overturned on appeal or the inmates sentence is about to expire the bail will kick in on the new case and the inmate would be turned over to our jail while the new case is pending; and 2) When bail is placed on an inmate it follows the inmate so when they are moved to different facilities it is one way for us to find them and also the state system knows there is another case still pending.

Brad Rovito, pled guilty to escape in the first degree, a Class D felony as a second felony offender. He is scheduled for sentencing June 15. 

Carmelo Torres, pled not guilty to two counts of promoting prison contraband in the first degree, a Class D felony. Motions are scheduled for June 15. Bail was set at $10,000 cash or $20,000 bond.

Newnon Flax, pled not guilty to promoting prison contraband in the first degree, a Class D felony. The case has been adjourned to June 15 for motions. Bail was set at $5,000. 

Joshua Heym, pled not guilty to promoting prison contraband in the first degree, a Class D felony. Motions are scheduled for June 15. Bail was set $5,000.

Damont Green, had his case adjourned to May 18.

Jesus Ruiz, was sentenced to one-and-one-half to three years in prison for attempted promoting prison contraband in the first degree, a Class E felony as a second felony offender. The sentence is to run consecutively to any term he is subject to.

Lorenzo Arline, had his case adjourned to June 15.

Wesley Kirkland, had his case adjourned to June 1.

Larry Lopez, had is case adjourned to May 18.

The following were seen in Wyoming County Court before Judge Mohun April 21.

Benjamin Bryant, who allegedly committed a crime in Java, was in court for motions. The case has been adjourned to May 16 for a Huntley Hearing. A Huntley Hearing is a pretrial hearing in New York State and is requested for the purpose of reviewing the manner in which the police obtained statements from the defendant.

Pamela Hardison, who allegedly committed a crime in Perry, had her case adjourned to May 16.

Preston Ruble, who committed a crime in Perry, was sentenced to five years probation on the conviction of sex offender fail to report change of address first offense, a Class E felony.

Mark Develder, who committed a crime in Perry, was sentenced on a violation of conditional discharged. Conditional discharge is continued and pay money owed.

Chester Harrington, who committed a crime in Perry, pled guilty to driving while intoxicated and driving while intoxicated per se, both as Class E felonies. The Per Se law is based not on the observations of the arresting police officer, but the results obtained from an Intoxilyzer machine. It is this result that dictates the offense as well potential certain legal presumptions. He was sentenced to one year interim probation. 

Todd Scharping, who committed a crime in Pike, pled guilty to criminal possession of a controlled substance in the fifth degree, a Class D felony; and driving while ability impaired by drugs, a misdemeanor as a second felony offender. He is scheduled for sentencing June 9.

Mark Develder, who accused of committing a crime in Warsaw, was sent to Wyoming County Jail without bail. The case is adjourned to Thursday.

Chadwick White, who allegedly committed a crime in Warsaw, pled not guilty to two counts of criminal sale of a controlled substance in the fifth degree, and two counts of criminal possession of a controlled substance in the fifth degree, all as Class D felonies. Motions are scheduled for June 16. Bail was set at $10,000 cash or $20,000 bond.

Scott Sanders, who is accused of committing a crime in Warsaw, pled not guilty to criminal sale of a controlled substance in the fifth degree and criminal possession of a controlled substance in the fifth degree, both are Class D felonies. Motions are scheduled for June 16. Bail was set at $15,000 cash and $30,000 bond.

Michael Case, who is accused of a crime in Warsaw, pled not guilty to criminal sale of a substance in the third degree and criminal possession of a controlled substance in the third degree, both are Class B felonies. Motions are scheduled for June 9.
